OFFICIAL RULES 

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR TO WIN. VOID WHERE PROHIBITED. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. PARTICIPATION IN THE SWEEPSTAKES CONSTITUTES YOUR AGREEMENT TO BE BOUND BY THESE OFFICIAL RULES AND THE DECISIONS OF THE SPONSOR, WHICH ARE BINDING IN ALL MATTERS RELATING TO THE SWEEPSTAKES. WINNING A PRIZE IS CONTINGENT UPON FULFILLING ALL REQUIREMENTS SET FORTH HEREIN. Do not enter this Sweepstakes if you are ineligible as set forth below at the time of entry. Individuals who participate in the Sweepstakes or submit an entry are sometimes referred to herein as “Entrant” or “you.”

ENTRY PERIOD: 11/6/25 to 10:00PM EST 11/14/25 

SPONSOR: Peet’s Coffee, Inc., 1400 Park Avenue, Emeryville, CA 94608 (“Sponsor”). KIND Snacks is not a sponsor, co-sponsor, or administrator of this Sweepstakes. Lubetzky Family Foundation is not a sponsor, co-sponsor, or administrator of this Sweepstakes.

ELIGIBILITY: The Sweepstakes is open to legal residents of the 48 contiguous United States and the District of Columbia who are 18 years of age or older at the time of entry.  Entrant must be an employee or representative of a frontline organization located in the contiguous United States. The frontline organization must be a 501(c)3 or public entity, providing first responder, education, or healthcare services to their community. Employees of Sponsor, influencers posting on behalf of Sponsor, their affiliate companies as well as the immediate family (spouse, parents, siblings and children) and household members of such employees are not eligible to enter. Void where prohibited. All federal, state and local laws and regulations apply.

TO ENTER: To receive an entry in the Sweepstakes, Entrants must:

This Sweepstakes is in no way sponsored, endorsed or administered by, or associated with Instagram. You are providing your information to the Sponsor, and not to Instagram. 

Entrants may only submit one (1) entry during the Entry Period. 

Any attempted form of entry other than as set forth here is prohibited; no automatic, programmed, robotic or similar means of entry are permitted. Sponsor shall not be responsible for lost, late, illegible, stolen, incomplete, invalid, unintelligible, misdirected, technically corrupted or garbled entries, which will be disqualified, or for problems of any kind whether mechanical, human or electronic. Only fully completed entry forms are eligible. Proof of submission will not be deemed to be proof of receipt by the Sponsor. In the event of a dispute over who submitted an entry, the entry will be deemed to have been submitted by the authorized account holder of the e-mail address submitted with the entry. The authorized account holder is deemed to be the natural person who is assigned to the e-mail address by the relevant entity responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. 

The Sweepstakes shall be subject to these Official Rules, and by entering, Entrants agree to be bound by the terms and conditions set forth below. The Sponsor reserves the right to make changes to the rules of the Sweepstakes.  Entrants are required to provide truthful information and the Sponsor will reject and delete any entry that it discovers to be false or fraudulent.  The Sponsor will disqualify any Entrant who does not meet the eligibility requirements and will also delete any entry as required by law. 

PRIZE DRAWING: For the Entry Period, four (4) winners for the “Peet’s Coffee World Kindness Day Sweepstakes” will be selected by random drawing from all eligible entries received on or about November 14, 2025.  
 

GRAND PRIZE: Donation size will be determined based on organization size and availability. Peet’s Coffee will donate coffee in the form of 10oz bags of coffee beans and KIND Snacks will donate KIND bars to four frontline organizations by December 31, 2025.

ODDS OF WINNING: Odds of winning depend on the number of eligible entries received during the Entry Period. 

WINNER NOTIFICATION/VERIFICATION: The potential winner will be notified by Instagram Direct Message and/or electronic mail. Sponsor may require each potential winner to complete, sign, and return an Affidavit of Eligibility and Liability/Publicity Release form, and other applicable documents, within seven (7) days of the date on the notification. If a potential winner cannot be contacted, fails to timely claim the prize, is disqualified, fails to timely execute and return any required forms, or if the prize or prize notification is returned as undeliverable for any reason, prize will be forfeited and a substitute winner shall be drawn randomly. If by reason of computer programming, printing, production or other error, more prizes are claimed than the number of prizes set forth in these Official Rules, a random drawing will be held to award the advertised number of prizes. Once verification of eligibility has been correctly received from the Sweepstakes winners, per these Official Rules, the Sweepstakes winners shall be the official "Prize Winner" of the Sweepstakes. The Sweepstakes Winners are responsible for all federal, state, provincial and local tax liabilities. 

NO LIABILITY & INDEMNIFICATION: The Sponsor is not responsible for and Entrants release Sponsor, its affiliates, and Instagram from any failures of any kind (whether caused by computer, technical, or human error) which may either limit the Entrant's ability to submit an entry, claim a prize, or otherwise participate in this Sweepstakes, or the Sponsor's ability to include all eligible entries, conduct random drawings, notify potential winners, or otherwise execute this Sweepstakes in the manner intended. Entrants further release and agree to indemnify the Sponsor and Sponsor's agents, and Instagram from all liability, claims, actions, loss, harm, damage, injury, cost or expense including without limitation, property damage, personal injury and/or death which may be sustained in connection with this Sweepstakes, including, but not limited to: (a) the receipt, ownership or use or misuse of any prize awarded; (b) participation in any Sweepstakes-related activity, including, without limitation, travel; (c) any claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trademark infringement or any other intellectual property-related cause of action; (d) any typographical or other error in these Official Rules or any other materials disseminated by the Sponsor; (e) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with any equipment, systems, networks, lines, satellites, servers, computers, or providers used by an Entrant or the Sponsor(s); (f) any incorrect or inaccurate information, whether caused by Entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (g) unauthorized human intervention in any part of the entry process or the Sweepstakes; (h) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; or (i) late, lost, undeliverable, damaged or stolen mail. 

PUBLICITY & MARKETING: Acceptance of the prize constitutes permission (except where prohibited) for the Sponsor to use Sweepstakes Winner's name, likeness, biography, statements, voice, image and any other personal characteristics, in all media, for any purpose, including without limitation marketing, promotional and publicity purposes without additional compensation to such winner or any limitation, and such individual releases the Sponsor from any liability with respect to such use. Submission of contact information in connection with this Sweepstakes (whether or not required), including, without limitation, mailing address, phone number, and email address during entry constitutes permission for the Sponsor to add Entrant to the Sponsor's database and to contact Entrant in the future for promotional and other reasons. An Entrant may opt-out of receiving such communications as set forth in the Sponsor's Privacy Policy or as provided within any such marketing materials (e.g., using the "Unsubscribe" feature provided in the footer of the Sponsor's emails). 

OTHER TERMS: Decisions of the Sponsor on all matters related to the Sweepstakes are final. The Sponsor reserves the right to extend, suspend, cancel or modify the Sweepstakes for any reason, including but not limited to, if fraud, misconduct or technical failures destroy the integrity of the Sweepstakes, or if a computer virus, bug, or other technical problem corrupts the administration, security, or proper administration of the Sweepstakes as determined by the Sponsor, in its sole discretion. Sponsor(s) reserves the right to disqualify or prohibit the participation of an individual if fraud or tampering is suspected, or if the individual fails to comply with any requirement of participation or with any provision in these Official Rules. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE (INCLUDING THE ENTRY SITE) OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. 

BY PARTICIPATING, ALL ENTRANTS AND ANY PRIZE WINNERS RELEASE, DISCHARGE, AND AGREE TO INDEMNIFY AND HOLD HARMLESS THE RELEASED PARTIES FROM AND AGAINST ANY LIABILITY FOR ANY DAMAGES, INJURY, DEATH, OR LOSSES, TO ANY PERSON OR PROPERTY OF ANY KIND, AS WELL AS CLAIMS/ACTIONS BASED ON PUBLICITY RIGHTS, DEFAMATION, AND/OR INVASION OF PRIVACY, THAT MAY ARISE IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM ACCEPTANCE, POSSESSION, MISUSE, OR USE OF THE PRIZE OR ANY PORTION THEREOF, OR PARTICIPATION IN ANY SWEEPSTAKES-RELATED ACTIVITY, OR PARTICIPATION IN THIS SWEEPSTAKES.

By entering this Sweepstakes, Entrants agree to the following Statement:

I expressly understand that Section 1542 of the Civil Code of California provides substantially as follows: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM, MUST HAVE MATERIALLY AFFECTED HIS SETTLEMENT WITH DEBTOR.” The provisions of this Section 1542 of the Civil Code of California and any similar law of any state, territory, or other jurisdiction are hereby expressly waived.

LIMITATIONS OF LIABILITY:  The Sweepstakes Entities are not responsible for late, lost, damaged, misdirected, incomplete, illegible, undeliverable, destroyed, and/or lost, late, misdirected, undeliverable or incomplete entries due to system errors or failures, or faulty transmissions and/or entries not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, or failed, incomplete, or garbled computer or telephone transmissions, or for any problems or technical malfunction(s) of any telephone network or lines, computer online systems, servers or providers, computer equipment, or entries not received by Sweepstakes Entities on account of technical problems or traffic congestion on computer networks, or any combination thereof, including any injury or damage to participant’s or any other person’s computer related to or resulting from participating in the Sweepstakes or downloading any material for the Sweepstakes, or other telecommunications malfunctions which may limit an entrant’s ability to participate.

THE PRIZE IS provided “as is” without any warranty, representation, or guarantee of any kind, express or implied, in fact or in law, whether now known or hereinafter enacted, relative to the use or enjoyment of the prize, including, without limitation, its quality, merchantability, fitness for a particular purpose, or non-infringement. ACCEPTANCE, PARTICIPATION IN AND/OR USE OF THE PRIZE IS AT THE PRIZE WINNER’S SOLE RISK. Further, THE SWEEPSTAKES ENTITIES accept no responsibilities for any additional expenses, omissions, delays, or re-routing resulting from any acts of any government or authority.

To the maximum extent permitted by law, in no event will the RELEASED PARTIES be responsible or otherwise liable for any damages or losses of any kind, including direct, indirect, incidental, consequential, special, exemplary, punitive, Or other damages, THAT MAY ARISE, DIRECTLY OR INDIRECTLY, FROM ACCEPTANCE, POSSESSION, MISUSE, OR USE OF THE PRIZE OR ANY PORTION THEREOF, OR PARTICIPATION IN ANY SWEEPSTAKES-RELATED ACTIVITY, OR PARTICIPATION IN THIS SWEEPSTAKES, including any access to or use of the website or any downloading from or printing material from the website.  Everything on the website is provided “as is” without warranty of any kind, either expressed or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Some jurisdictions may not allow limitations or exclusions of liability for incidental or consequential damages or exclusion of implied warranties, so some of the above limitations or exclusions may not apply. 

DISPUTES:  Except where prohibited, as a condition of participating in this Sweepstakes, each Entrant agrees that: (i) any and all disputes, claims, and causes of action arising out of or in connection with this Sweepstakes shall be resolved individually, without resort to any form of class action; (ii) any judicial proceeding shall take place exclusively in the appropriate federal or state court located in San Francisco, California; (iii) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, if any, including costs associated with entering this Sweepstakes, but in no event to exceed two hundred fifty dollars ($250), and in no event will attorneys’ fees be recoverable; (iv) other than for actual out-of-pocket costs incurred, under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to seek indirect, incidental, consequential, special, exemplary, punitive, or other damages, and/or any and all rights to have damages multiplied or otherwise increased; (v) Entrant’s remedies are limited to a claim for money damages (if any) and he/she waives any right to seek injunctive or equitable relief; and (vi) all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, the rights and obligations of Entrants and the Sweepstakes Entities in connection with the Sweepstakes, and any dispute arising under or related thereto (whether for breach of contract, tortious conduct, or otherwise) will be governed by the internal laws of the State of California without giving effect to any conflicts of law or choice of law rules or provisions that would cause the application of any other state’s or jurisdiction’s laws.

SEVERABILITY:  The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. If any provision of the Official Rules is determined to be invalid or otherwise unenforceable, the other provisions will remain in effect and will be construed as if the invalid or unenforceable provision were not contained herein.

MISCELLANEOUS:  These Official Rules contain the full and complete understanding with respect to the Sweepstakes and supersede all prior and contemporaneous agreements, representations and understandings, whether oral or written. The headings herein are for convenience only, do not constitute a part of these Official Rules, and shall not be deemed to limit or affect any of the provisions hereof. No amendment to, or waiver of, any provision of these Official Rules shall be effective unless in writing and signed by Sponsor.  The waiver by the Sweepstakes Entities of any provision of these Official Rules shall not constitute a waiver of any other provision herein. The rights and obligations hereunder may not be assigned by Entrant, whether by operation of law or otherwise, without the prior written consent of Sponsor, and any attempted assignment in violation of the foregoing shall be null and void. These Official Rules shall be binding upon, and inure to the benefit of, the permitted successors and assigns of the Sweepstakes Entities and Entrant.
